Terms of Service

By accessing or using LarqShield ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or a notice on the Service. Your continued use after such changes constitutes acceptance of the updated Terms.

LarqShield is a cloud-based platform for Amazon marketplace sellers that provides warranty tracking, claim management, document storage, analytics, and team collaboration tools. The Service is designed to help Amazon sellers manage A-to-Z claims, warranty returns, and reimbursement requests.

LarqShield is not affiliated with, endorsed by, or sponsored by Amazon.com, Inc. We are an independent third-party service provider.

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Not share your login credentials with any third party
• Be responsible for all activities that occur under your account

You must be at least 18 years old to create an account. By registering, you represent that you have the legal capacity to enter into these Terms.

LarqShield offers a free plan and paid subscription plans ("Pro" and "Team"). Paid plans are billed monthly or annually in advance via Stripe, our third-party payment processor.

Cancellation: You may cancel your subscription at any time from your billing settings. You will continue to have access to paid features until the end of your current billing period. No refunds are provided for partial billing periods, except as required by applicable law.

Price changes: We reserve the right to change pricing with 30 days' advance notice. Your subscription will continue at the new price upon your next renewal unless you cancel before then.

Free plan limits: The free plan is subject to resource limits (products, claims, storage) as described in the pricing section. We reserve the right to modify free plan limits with reasonable notice.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Upload or transmit viruses, malware, or malicious code
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Scrape, data-mine, or extract data from the Service using automated means
• Submit false, fraudulent, or misleading information
• Resell or sublicense the Service without our written permission

You retain ownership of all data and content you upload to the Service ("User Content"). By uploading User Content, you grant LarqShield a limited, non-exclusive licence to store, process, and display your content solely to provide the Service.

You are solely responsible for the accuracy and legality of your User Content. We do not review User Content and are not responsible for any errors or omissions in it.

Upon account deletion or subscription cancellation, you may request an export of your data within 30 days. After this period, data may be permanently deleted from our systems.

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of LarqShield and its licensors. The Service is protected by copyright, trademark, and other laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the Service without our explicit written permission.

If you invite team members to your workspace (available on the Team plan), you are responsible for their actions within the Service. You must ensure that team members comply with these Terms.

You may revoke team member access at any time from your workspace settings. Upon revocation, team members will immediately lose access to your workspace.

The Service integrates with or links to third-party services including Stripe (payment processing) and Supabase (infrastructure). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the acts or omissions of any third-party service provider.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee any specific outcome from use of the Service, including claim resolution or reimbursement amounts.

To the maximum extent permitted by applicable law, LarqShield and its affiliates, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Service
• Any unauthorized access to or use of our servers and your data
• Any interruption or cessation of transmission to or from the Service
• Any decisions made on the basis of information provided by the Service

Our aggregate liability for all claims relating to the Service shall not exceed the greater of (a) $100 USD or (b) the amounts paid by you to LarqShield in the 12 months prior to the claim.

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France, except where mandatory local consumer protection laws apply.

We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, third parties, or the integrity of the Service.

Upon termination, your right to use the Service will cease immediately. You may request an export of your data within 30 days of termination.
